Welcome to brunetteco.com (the "Site"), operated by Brunette + Co. Salon Studio ("Brunette + Co.", "we", "us", "our"), 2843 N. Friendship Rd, Paducah, KY 42001. By visiting the Site or placing an order, you agree to these Terms of Service. If you do not agree, please do not use the Site.

These terms apply to the online store only. Policies for salon appointments and services are on our Salon Policies page.

1. What We Sell

Our online store sells salon hair care products and related merchandise only. We do not sell salon services or gift cards online. Product descriptions, images and prices are provided as accurately as we can, but colors may vary by screen, and we do not guarantee that every description is error-free.

2. Eligibility and Your Account

You must be at least 18 years old, or have a parent or guardian's permission, to place an order. If you create an account, you are responsible for keeping your login details private and for all activity under your account.

3. Pricing and Availability

All prices are in U.S. dollars. We may change prices or discontinue products at any time. We may limit quantities, and we may refuse or cancel any order, including for pricing errors, stock issues or suspected fraud. If we cancel an order that was already paid, we will refund it in full.

4. Payment

We accept Shop Pay, PayPal and the major credit cards supported by Shopify Payments. Payment is charged when you place your order. Payments are processed securely by Shopify and our payment partners; we do not store your full card number. Sales tax is added where required by law.

5. Shipping

  • We ship within the United States only.
  • Orders of $50 or more, after discounts and before tax, ship free. For orders under $50 after discounts, the customer pays shipping, shown at checkout.
  • Orders are picked, packed and shipped within two (2) business days of being placed.
  • Delivery times depend on the carrier and your location and are estimates, not guarantees. Once an order has shipped, the carrier is responsible for delivery. Please check your shipping address carefully; we are not responsible for orders sent to an incorrect address entered at checkout.

6. Returns and Exchanges

We want you to love your products. Because hair care products are personal-use items, our policy is:

  • Used products cannot be returned or exchanged.
  • Unused products may be returned or exchanged if they are unopened, unused, and in their original condition and packaging. Returns and exchanges must be requested within 15 days of delivery.
  • Exchanges follow the same rules as returns. Exchanges are for the same item or another product of equal value, subject to availability.
  • Damaged, defective or incorrect items: please contact us within 7 days of delivery with your order number and a photo. We will replace the item or refund you.
  • How to start a return: email brunettecosalon@gmail.com with your order number before sending anything back. Returns sent without contacting us first may not be accepted.
  • Return shipping: the customer pays return shipping unless the return is due to our error or a damaged or defective item. We recommend using a tracked shipping method; we are not responsible for returns lost in transit.
  • Refunds: approved refunds go to your original payment method, typically within 5-10 business days after we receive and inspect the item. Original shipping charges are not refunded unless the return is due to our error.

7. Product Use and Safety

Always read product labels and follow directions. Perform a patch test if you have sensitive skin or allergies, and check ingredients before use. Contact a medical professional if you have a reaction. Information on the Site is general and is not medical or professional advice.

8. Intellectual Property

All content on the Site, including text, photos, logos and design, belongs to Brunette + Co. or its licensors and may not be copied, reproduced or used without our written permission.

9. Acceptable Use

You agree not to misuse the Site, including by attempting to gain unauthorized access, introducing harmful code, scraping the Site, or using it for any unlawful purpose.

10. Privacy

Our use of your personal information is described in our Privacy Policy.

11. Third-Party Links and Services

The Site may link to or rely on third-party services (such as Shopify, PayPal, and shipping carriers). We are not responsible for their content, policies or practices.

12. Disclaimer and Limitation of Liability

The Site and products are provided "as is" and "as available" to the fullest extent allowed by law. Manufacturer warranties, if any, apply to products. To the fullest extent permitted by law, Brunette + Co. is not liable for indirect, incidental or consequential damages arising from your use of the Site or products, and our total liability for any claim is limited to the amount you paid for the order in question. Some jurisdictions do not allow certain limitations, so some of this may not apply to you.

13. Governing Law

These terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Kentucky.

14. Changes to These Terms

We may update these terms from time to time. The version posted on the Site when you place an order applies to that order.
